1. Overview of the Service

Level Up Website is a website design and development company that helps businesses renovate, upgrade, and transform their digital presence. Our services include website redesign, new website creation, front-end and back-end development, branding, performance optimization, and ongoing support. We also offer AI-powered tools on the Platform, including a Website Remixer (which generates a redesigned mockup of your existing site) and a Website Creator (which generates a mockup based on your project brief).

2. Eligibility

You must be at least 18 years of age and a resident of Canada or the United States to use the Platform. By using the Platform, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

3. AI-Powered Tools

The Platform offers free AI-powered tools including the Website Remixer and Website Creator. By using these tools, you acknowledge and agree that:

• Generated mockups are conceptual previews only and do not represent a final deliverable or guarantee of any specific design outcome.
• Mockups are generated using third-party AI services (Google Vertex AI) and may vary in quality, accuracy, and style.
• Free tool usage is limited to one generation per IP address. Subsequent uses will return the previously cached result.
• We reserve the right to modify, limit, or discontinue the free AI tools at any time without notice.
• You may not use automated tools, bots, or scripts to repeatedly access or abuse the AI generation features.

4. Services, Scope of Work & Pricing

4.1 Service Tiers. We offer two service tiers:

• Ground Up ($199 one-time) — A brand-new website built from scratch based on your project brief. Includes a fully designed and coded single-page website, standard mobile optimization, and hosting on our enterprise-grade servers.
• Level Up ($399 one-time) — A complete redesign of your existing website. Includes the live website exactly as shown in your interactive mockup, standard mobile optimization, and the technical labor required to route your existing domain (via DNS A-Record update) to the new site.

All prices are displayed in USD or CAD depending on your detected location. The numeric amount is the same in both currencies.

4.2 Acceptance of Design (“As-Is” Delivery). By completing a purchase, you are acquiring the exact digital website design, layout, and copy presented to you in your live interactive mockup. This is a one-time purchase of a finished digital product, not an ongoing development contract.

4.3 Zero-Revision Policy. Your one-time fee covers the delivery of the exact website design presented in your mockup and, for Level Up purchases, the technical labor required to route your existing domain to the new site.

• What is included: The live website exactly as shown, standard mobile optimization, and the technical domain connection (Level Up only).
• What is NOT included: Custom post-purchase revisions, copywriting changes, image swapping, or ongoing IT support.

If you require customized changes, text updates, or additional pages after the website has been launched, these can be quoted separately as an independent project.

4.4 Hosting & Infrastructure. We host your static website on our enterprise-grade servers at no ongoing monthly cost to you for the first 30 days. After 30 days, hosting is $5/month. You retain 100% ownership and control of your domain name. You can point your domain away from our servers at any time.

4.5 Payment. All payments are processed securely through Stripe. Payment is collected in full at the time of purchase. No recurring subscriptions are created.

4.6 Domain Registration. If you purchase a custom domain through us as part of your order, domain registration is included at no additional cost for the first year. Beginning on the first anniversary of your purchase date, an annual renewal fee of $20/year will apply to maintain your domain. You will be notified in advance of any upcoming renewal. You retain full ownership of your domain at all times and may transfer it to another registrar of your choosing at any point.

5. Refund Policy

Strict No-Refund Policy on Digital Goods. Due to the immediate nature of digital deliverables and the manual technical labor required to execute the domain handoff, all sales are final. When you complete a purchase, you are acknowledging that you have reviewed the live interactive mockup of your new website and are satisfied with the design, text, and layout exactly as presented.

Refunds will not be issued for:

• Dislike of the design after purchase (as it was fully previewed beforehand).
• Changes of mind regarding your business name, branding, or digital strategy.
• Inability to provide us with the necessary Domain Registrar access to complete the launch. (If you cannot provide access, we will provide you with the exact IP address instructions so your IT provider can manually update your records.)

If we are fundamentally unable to host the generated code due to an error on our servers, a full refund will be issued.

6. Deliverables and Intellectual Property

6.1 Ownership of Deliverables. Upon full payment, you will own the final website design, code, and assets delivered to you as part of your project, unless otherwise specified in your project proposal.

6.2 Portfolio Rights. We reserve the right to display completed projects in our portfolio, case studies, and marketing materials unless you request otherwise in writing.

6.3 Platform Content. All content on the Platform, including text, graphics, logos, icons, images, AI-generated mockups, and software, is the property of Level Up Website and is protected by applicable copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or create derivative works from any Platform content without our prior written consent.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEVEL UP WEBSITE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

• Any AI-generated mockup, including its accuracy, quality, or suitability for any purpose.
• Any interruption, downtime, or failure of the Platform or its AI-powered tools.
• Any loss of revenue, data, or business opportunity resulting from the use or inability to use the Platform.
• Any third-party services, hosting providers, or integrations used in connection with your project.

Our total aggregate liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount you paid to us for the specific service giving rise to the claim.

8. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose.
• Impersonate any person or entity.
• Interfere with or disrupt the Platform or its servers.
• Attempt to gain unauthorized access to any part of the Platform.
• Use automated tools, bots, or scripts to scrape, collect data from, or abuse any feature of the Platform.
• Submit false, misleading, or harmful content through any form or tool on the Platform.
• Attempt to circumvent usage limits on the free AI-powered tools.

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with applicable Canadian privacy legislation (PIPA, PIPEDA, CASL) and U.S. privacy laws.

10. Termination

We reserve the right to suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections 5, 6, 7, 11, and 12 shall survive termination.

11. Governing Law and Dispute Resolution

Regardless of where you access or use the Platform from, these Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Platform shall be resolved exclusively in the courts located in the Province of Alberta, Canada. By using the Platform or purchasing any service, you irrevocably consent to the personal jurisdiction of such courts.

12. Indemnification

You agree to indemnify, defend, and hold harmless Level Up Website and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Platform with a new effective date. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
